Update: Council has received the Panel Report for Amendment C113.

The Panel recommended that Amendment C113 be adopted as exhibited subject to the following:

  • Delete 47 Smith Road from the heritage Overlay (HO155)
  • Revise the address in the schedule to the Heritage Overlay for HO155 and the Citation to refer to 49 Smiths Road, Templestowe (rather than 47-49 Smiths road, Templestowe)
  • Update the citation for HO155 to reflect current practice and circumstances as part of the next review of heritage provisions in the Manningham Planning Scheme. (This was a further recommendation to be undertaken at a later date)

Council will consider the Panel Report at its meeting on 25 July 2017 and decide whether or not to adopt the amendment, with or without changes.

The Minister for Planning has the responsibility for making the final decision regarding the approval of the Amendment and its introduction into the Manningham Planning Scheme.

Background

Manningham City Council has prepared Amendment C113 to the Manningham Planning Scheme.

Amendment C113 affects land at 66-68 Hall Road, Warrandyte South (also known as the Warrandyte South Hall) and seven heritage places currently included within the Heritage Overlay of the Manningham Planning Scheme.

The changes proposed include:

  • Amending the Schedule to the Heritage Overlay to allow currently ‘prohibited uses’ on land at 66-68 Hall Road, Warrandyte South; and
  • Making corrections to the Heritage Overlay of seven heritage listed properties, details of which are outlined in the Explanatory Report

Amendment C113 was placed on public exhibition from 28 November 2016 until 20 January 2017.

Four submissions were received; three of which support the amendment and one late submission, which objected to the amendment.

At its meeting on 21 February 2017, Council considered all submissions received in relation to the amendment and resolved to request that the Minister for Planning appoint an Independent Panel to consider all submissions. For more information, please see the Council Meeting Minutes 21 February
