What is the purpose of the Amendment?
The purpose of Amendment C113 to the Manningham Planning Scheme is twofold.
Firstly, the amendment is required to amend the Schedule to the Heritage Overlay as it relates to 66-68 Hall Road, Warrandyte South commonly known as Warrandyte South Hall.
Secondly, the amendment is required to introduce a number of corrections, which address some anomalies with the mapping and property description for seven heritage listed properties.
What does this Amendment change?
Amendment C113 proposes to change the uses permitted within the Warrandyte South Hall and make corrections to the Heritage Overlay of seven heritage listed properties.
Uses permitted in the Warrandyte South Hall
The amendment proposes to modify the Schedule to the Heritage Overlay as it relates to the Warrandyte South Hall at 66-68 Hall Road, Warrandyte South.
The Warrandyte South Hall has been identified in the Manningham Heritage Study as being of local significance as a community meeting place recreated through community efforts after the 1939 bushfires. The exterior of the Hall is intact to its original 1939 design, and the building has been identified as being of local significance for its architectural integrity.
This hall has been used as a community meeting place. In past decades, the use as a meeting place focused on public events such as dances, shows, and other events. The nature of the original use of the premises is classified as a “Place of Assembly”.
The current zoning of the land that this hall sits on, as a Rural Conservation Zone – Schedule 3, specifies Place of Assembly (other than carnival and circus) as a prohibited use.
The Heritage Overlay applying over the site does not allow for a prohibited use to be permitted. Accordingly, the amendment to the Schedule to the Heritage Overlay is proposed to allow a prohibited use to be permitted on the land subject to the approval of a planning permit. In other words, in the event that this amendment comes into effect, a planning permit will be required to facilitate any prohibited uses, such as a place of assembly.
The proposed amendment is not likely to result in a significant change on the nature of the possible future uses for the land as it is intended that future uses should maintain or respect the use of the hall for public purposes. As the landowner, Council will be able to ensure that only approved uses for the site are permitted. The ability to consider prohibited uses will allow an increase in the building’s function and ensure continued use for and long term care and maintenance for the Warrandyte South Hall.
Amendment C113 is consistent with the principles of the Burra Charter in that an important consideration for preserving the heritage value of this place is retaining public access to the site by encouraging either a community use or commercial use.
Corrections of the Heritage Overlay of seven heritage listed properties
The Amendment also incorporates corrections to seven heritage listed properties in Clause 43.01 of the Heritage Overlay.
Amendment C113 seeks to correct administrative errors in the Heritage Overlay and more accurately reflect the current circumstances. The corrections are intended to address the mapping errors that have been identified through the day to day operation of the Manningham Planning Scheme and errors in the property description of heritage places.
It will provide greater clarity for landowners and will enable the land to be used and developed in an appropriate manner, particularly where sites currently affected by the controls have no identified heritage values.
Definitions and Terminology
Heritage Overlay: The Heritage Overlay identifies places of heritage importance and seeks to conserve and enhance places of heritage significance, and to ensure it is not adversely affected by development. The Heritage Overlay provisions are set out at Clause 43.01 within all Victorian Local Planning Schemes. The Heritage Overlay details when a planning permit is required.
Schedule to the Heritage Overlay: A local Schedule to the Heritage Overlay lists the properties affected by the Heritage Overlay within a particular municipality and any additional controls that may apply to that particular site.
Heritage Overlay Mapping: The Heritage Overlay is mapped in the Planning Scheme to show the location and extent of heritage controls over a particular heritage place

Manningham Planning Scheme: A planning scheme is a statutory document which sets out objectives, policies and provisions relating to the use, development, protection and conservation of land in the area to which it applies. A planning scheme regulates the use and development of land through planning provisions to achieve those objectives and policies.
Prohibited Use: Uses which conflict with, or are irrelevant to, the purpose of the schedule to the overlay.
Place of Assembly: Land where people congregate for religious or cultural activities, entertainment, or meetings.
