What is Amendment C123?

    Amendment C123 is a proposed amendment to the Manningham Planning Scheme, which aims to introduce new public open space contribution rates for subdivisions of three or more lots.

    Amendment C123 proposes to introduce:

    • An 8% open space contribution for high growth areas where there is a greater need for public open space.
    • A 5% open space contribution in the remainder of the municipality, where less change is forecast.

    In Manningham high growth areas include Doncaster Hill and land covered by the Design and Development Overlay, including:

    • Schedule 8 – Residential areas surrounding activity centres and along main roads
    • Schedule 9 – Residential Areas within The Pines Activity Centre, and
    • Schedule 13 – Residential areas surrounding prominent intersections and/or interfacing commercial areas.

    Since 2005, a mandatory five per cent public open space contribution has been in place for Manningham’s Doncaster Hill precinct.This means that the open space contribution rate for Doncaster Hill would increase from 5 per cent to 8 per cent.

    The proposed rates have been based on the Manningham Council Open Space Contributions Plan, March 2017, prepared for Council by SGS Economics and Planning. 

    Why is Council proposing new open space contribution rates?

    Our community has told us that they value public open space and Council is proposing Amendment C123 to ensure that sufficient open space areas are provided for our community now and in the future.

    The proposal will allow Council to improve the quality and increase the amount of open space to meet the needs of the existing and future residents. Open space is fundamental to the liveability and identity of Manningham. Access to high quality and diverse open space within walking distance of home and work is important to health, as it provides opportunities for social interaction, recreation, sport and relaxation.

    The proposal will ensure Council has adequate funding for public open space in different areas across the municipality.

    What are the proposed rates for open space contributions?

    Amendment C123 proposes to introduce:

    How have the proposed rates been decided?

    The proposed rates have been based on the Manningham Council Open Space Contributions Plan, March 2017, prepared for Council by SGS Economics and Planning. 

    The proposed rates take into account the growth and development anticipated in different areas of Manningham. Growth is anticipated to be particularly concentrated in areas such as residential areas surrounding activity centres, along main roads, near prominent intersections and/or commercial areas or within The Pines Activity Centre. The proposed contribution rate of eight per cent in these growth areas, is higher than the proposed rate of five per cent for the remainder of Manningham.

    What are high growth areas?

    In Manningham high growth areas include Doncaster Hill and land covered by the Design and Development Overlay, including:

    • Schedule 8 – Residential areas surrounding activity centres and along main roads
    • Schedule 9 – Residential Areas within The Pines Activity Centre, and
    • Schedule 13 – Residential areas surrounding prominent intersections and/or interfacing commercial areas. 


    What is the current open space contributions?

    Under the Subdivision Act 1988, any developer seeking to subdivide land into three or more lots is required to provide an open space contribution to Council. This is to compensate for the increased demand for open space caused by the subdivision. The contribution is assessed as a percentage of the property’s site value (up to a maximum of five per cent) and can be provided in the form of land, money or a combination of both.

    An existing clause in the Manningham Planning Scheme, enables Council to stipulate an open space requirement greater than five per cent.

    Since 2005, a mandatory five per cent public open space contribution has been in place for Manningham’s Doncaster Hill precinct. For the remaining areas of Manningham public open space contributions have not been mandatory, however have been applied to subdivisions of three or more lots. The contribution rates have been set on a case by case basis, ranging from zero to five per cent.

    Where is Doncaster Hill?

    Doncaster Hill has a 20 year vision to create a sustainable, contemporary mixed use centre, comprising apartment style living opportunities as well as retail, commercial, social, community and entertainment facilities in the heart of Manningham. 

    Set across 58 hectares, the intersection of Doncaster, Williamsons and Tram roads is the gateway to Doncaster Hill. Doncaster Hill is bordered to the west by the Tullamore Estate (former Eastern Golf Course site), to the north by Westfield Drive, to the east by the Manningham Civic Centre and to the south by Merlin Street.

    Doncaster Hill is a high growth area and under the proposed Amendment C123 the open space contribution rate for Doncaster Hill would increase from five per cent to eight per cent.

    Why is the Tullamore Estate exempt from the proposed open space contributions?

    The Tullamore Estate, former Eastern Golf Course site, is exempt from this amendment because a 20 per cent open space contribution in the form of land, is already required for this estate.

    What is Amendment C115, is it the same as Amendment C123?

    Yes, Amendment C123 was previously known, and endorsed by Council for public exhibition, as Amendment C115. It is now known and is being exhibited as Amendment C123.
