Amendment C112 – removing restrictive covenants from 775, 777 and 779 Doncaster Road

UPDATE: Amendment C112 to the Manningham Planning Scheme was approved and gazetted by the Minister for Planning on 3 August 2013.

Amendment C112 to the Manningham Planning Scheme proposes to remove the restrictive covenant from three properties on Doncaster Road in Doncaster.

The properties include:

  • 775 Doncaster Road, Doncaster (Lot 20 on Plan of Subdivision 54013 Certificate of Title Volume 8308 Folio 572);
  • 777 Doncaster Road, Doncaster (Lot 19 on Plan of Subdivision 54013 Certificate of Title Volume 8308 Folio 571); and
  • 779 Doncaster Road, Doncaster (Lot 18 on Plan of Subdivision 54013 Certificate of Title Volume 8308 Folio 570).

The Amendment seeks to change the Schedule to Clause 52.02 to the Manningham Planning Scheme to remove the restrictive covenants that encumber the land at 775, 777 and 779 Doncaster Road, Doncaster.

The restrictive covenants that currently apply to the these properties allow for only one dwelling to be constructed on each lot and require the dwellings to be constructed of specified materials.

The proposed Amendment has been made at the request of Wilman Pty Ltd.
