Planning Scheme Amendment C130mann - 11 Toronto Avenue, Doncaster - now closed

Amendment C130mann to the Manningham Planning Scheme proposes to delete the Design and Development Overlay, Schedule 7 (11 Toronto Avenue, Doncaster) from 11 Toronto Avenue, Doncaster and amend maps 6DDO and 7DDO accordingly.
This will allow for the subdivision of 11 Toronto Avenue, Doncaster to be carried out in accordance with the current requirements of the Manningham Planning Scheme.
The Design and Development Overlay, Schedule 7 (which currently applies) only permits the subdivision of the land in accordance with Planning Permit PL02/013542. It also does not allow a planning permit to be granted to subdivide the land which is not in accordance with this requirement.
Planning Permit PL02/013542 approved the construction of two dwellings. This was never acted upon. The Design and Development Overlay, Schedule 7 therefore has the effect of prohibiting all subdivision proposals on the land.
Approval to subdivide 11 Toronto Avenue, Doncaster, is not being sought under proposed Planning Scheme Amendment C130mann. However, should the Amendment be approved, the land would be able to be subdivided under a separate planning application.
The Design and Development Overlay, Schedule 7 control does not support good planning outcomes having regard for the controls Manningham Council has determined should apply to the land by virtue of the present zoning.
Amendment C130mann proposes to:
- Delete the Design and Development Overlay, Schedule 7 (11 Toronto Avenue, Doncaster) from 11 Toronto Avenue, Doncaster.
This amendment was prepared on behalf of the landowner by the Manningham City Council, which is the planning authority for the amendment.
