Amendment C117 - Planning for Manningham's rural areas

Update: The Minister for Planning has resolved to approve Amendment C117 to the Manningham Planning Scheme with changes and the Amendment was gazetted on 20 September 2019.

The Amendment was approved in line with the recommendations of the Independent Panel held during October 2018. See the document library for the Panel’s Report.

Amendment C117 to the Manningham Planning Scheme proposed changes to Council’s Municipal Strategic Statement (MSS) to allow non-residential uses in green wedge areas and a new local policy focussing on non-residential uses in the Rural Conservation Zone.

The Minister has not approved the proposed changes to the MSS, the new local policy has been approved as part of the Amendment.

Specifically, the changes that the Minister made to the Amendment included:

  • Amending Clause 21.07 to remove content encouraging non-residential uses (including tourism uses), in accordance with the recommendations of the panel.
  • Amending Clause 21.16, Clause 22.19 and Clause 22.20 to remove references to the Rural Areas Discretionary Land Use Position Paper (2017).
  • Amending Clause 22.20 to enable its translation into the Planning Policy Framework. The title of the policy has also been amended to 'Use and development in the Rural Conservation Zone'.
  • Minor wording and format changes to ensure compliance with the requirements of the Ministerial Direction on the Form and Content of Planning Schemes.
